Health Agreement

The following is MyNextPuppy’s health agreement which will accompany every puppy that leaves our
This agreement is made between the below described seller and buyer for the purchase of the below described puppy. The terms of this agreement are invalid unless signed by both the seller and the buyer.

Immediate Veterinarian Examination Required:
The seller guarantees the below described puppy to be in good health at the time of sale. The puppy will have its first shot and will be wormed before it leaves the property of the seller. The seller gives the buyer four calendar days beginning the day the puppy leaves the seller’s property which is indicated as dated below to verify the health of the puppy by a licensed veterinarian. The buyer agrees to take the puppy to a licensed veterinarian for a complete health examination before the four day health agreement expires. If the below describe buyer fails to have a licensed veterinarian perform a complete health examination on the below described puppy before the four calendar day health agreement expires, this agreement becomes null and void, and the seller is no longer obligated to this agreement. A dated report from the licensed veterinarian is required to maintain the terms of this agreement. In the event the examining licensed veterinarian determines the puppy has a life threatening illness which was contracted before the buyer took the puppy from the seller’s property, the seller will replace the puppy with another puppy when one becomes available. This replacement will take place with the following restrictions: (1) The sick puppy must be returned to the seller within four calendar days of the veterinary examination with a written statement from the examining veterinarian detailing the diagnosis, along with any papers and items originally sent with the puppy. (2) The seller will provide the puppies from which the buyer will choose a replacement. (3) Seller retains the right to have the sick puppy examined by a veterinarian of seller’s choice before any exchange shall be made. (4) In the event the puppy should die during the health agreement period, the buyer must provide the cause of death through an autopsy report along with the information required for the seller to contact the laboratory directly. The autopsy must be performed by a licensed diagnostic laboratory.

Six Month Health Agreement:
The below described puppy is guaranteed by the seller to be free of any life threatening birth defects for its first six months of life. If during the puppy’s first six months of life it is determined by a licensed veterinary to have a life threatening birth defect, the buyer agrees to contact the seller within two calendar days of the diagnosis. The puppy is to be returned to the seller within four calendar days of the diagnosis along with the medical record and a written statement from the licensed veterinarian detailing the diagnosis, along with any papers and items sent with the puppy at the time of sale. The seller will replace the puppy with another puppy when one becomes available, and the seller will provide the puppies from which the buyer will choose a replacement. The seller retains the right to have the puppy examined by a veterinarian of the seller’s choice to verify the presence of a life threatening birth defect before any exchange shall be made. In the event the puppy should die during the health agreement period, the buyer must provide the cause of death through an autopsy report along with the information required for the seller to contact the laboratory directly. The autopsy must be performed by a licensed diagnostic laboratory.

Health Agreement Exclusions:
This guarantee does not cover internal or external parasites, worms, Coccidiosis, or hypoglycemia. It does not cover any injury induced after the sale. This puppy is being sold as a pet quality animal only. The seller does not guarantee the quality of the puppy’s coat or color, body size, fertility, testicle descent, proper bite, or whether the ears stand or not. The seller is not responsible for any expenses incurred by buyer (veterinary, travel, etc) before or after the departure of the puppy from the seller’s property. The buyer is responsible for all attorney fees incurred by both the seller and the buyer pertaining to the contents of this agreement. Regardless of the place of signing of this agreement, buyer agrees that for purpose of venue, this agreement was entered into in Surry County, NC, and any dispute will be litigated or arbitrated in Surry County, NC. This agreement must be signed by the buyer and returned to seller prior to removal of the below described puppy from the seller’s property. If the seller does not receive this health agreement signed by the new owner listed on the sales receipt before the below described puppy is removed from the seller’s property, the terms of this agreement are null and void and the seller has the right to void the puppy registration.
